Optimer Performance Fibers, the marketer of the Dri-release and FreshGuard brands for moisture management technologies, has reached a settlement outside court with 180s in relation to its claims for trademark infringement and false advertising, among others. According to Optimer, 180s, an American brand of ear-warmers and other performance apparel and accessories, used a fabric blend notification and Optimer’s patent number on products that did not contain its proprietary fabric blend. 180s used to be a customer of Optimer, but no longer is. The case which was basically about work shirts and ear-warmers, has now been settled under terms which were not disclosed.
